As we predicted would happen here, this morning I saw a prison guard civilain defense attorney on TV quoting rule 104 of the Manual for Courts Martial as part of his defense strategy.
Rule 104 reads in part
No person subject to the code may attempt to coerce or, by any unauthorized means, influence the action of a court martial...in reaching the findings or sentence in any case...Will this prevent conviction? Not if there is any evidence worth a darn. But it gets the defense attorney on TV where he can begin attempting to discredit the President, the Secretary of Defense, etc.
